Dairy Units
This includes milk chilling plants that handle or process anywhere from 500 litres up to 50,000 litres of milk per day, or manage between 2.5 to 2,500 million tonnes of milk solids each year. Vegetable Oil Processing: Units involved in processing vegetable oils through solvent extraction and refineries, as well as oil pressing units, which produce up to 2 million tonnes daily or have an annual turnover of ₹12 lakh or more.
Meat Processing
Facilities with a processing capacity of up to 500 kilograms per day or up to 150 metric tonnes annually.
Food Processing and Packaging
Any food processing business — including those involved in repacking or relabelling — with a capacity greater than 100 kg/litre and up to 2 million tonnes per day. This covers units handling grains, cereals, pulses, and related products.
Storage Operators
Businesses that store between 500-50,000 million tonnes of food-products, not including cold storage or controlled environment facilities.
Wholesalers & Distributors
Wholesalers with an annual turnover of up to ₹30 crores, and vendors, suppliers, and caterers with turnover up to ₹20 crores per year.
Food Establishments
Operators of food stalls like dhabas, clubs, and canteens with yearly revenue of ₹12 lakh or more.
Hotels & Restaurants
Hotels rated from 5 stars up to but not including 5 stars, and restaurants with an annual turnover of up to ₹20 crores.

Features of FSSAI State License

If a food business operator fails to obtain an FSSAI license, they can face legal action and penalties for non-compliance. Getting an FSSAI license is a one-time cost and remains valid for a period ranging from 1 to 5 years, depending on the size and needs of the business. Anyone involved in food-related activities—whether it's manufacturing, retailing, transportation or any other handling of food products—must have a valid state-level license. The issuance of licenses or registration certificates is regulated under the Food Safety and Standards Regulations, 2011.   • Step 4: Once all requirements are met, the licensing authority will issue your FSSAI license renewal within 60 days.
  • Step 5: If you don’t receive any update or decision within 60 days of submitting your application, you are allowed to continue operating your food business without further delay.

Consequences and Penalties for Non-Compliance

Each individual authorized or approved by the FSSAI must follow the rules and regulations outlined in the Food Safety and Standards Act of 2006. The food security officer conducts a general inspection of the food production facility and agrees on compliance using the checklist.

  • For non-compliance with Food Safety Officer instructions - The penalty value is ₹2-3 lakhs.
  • For extraneous food items - The fine sum is ₹1 lakh.
  • For extraneous food items -The fine sum is ₹ 1 crore.

Penalty if a Company Operates Without an FSSAI License :

A food business owner or operator conducts business operations without acquiring FSSAI license shall be punishable as specified in the Act. The person or firm found guilty of any violation may be punished with up to six months’ imprisonment and a fine.

Penalty if the Food Article is Sub-Standard :

If a person or a company is found selling substandard quality of food and flouting the compliance requirements, the same shall be penalised within a time with a fine.

Penalty if a Food Item Is Below the Specified Standard :

If an individual or a business is found selling lower quality of food and violating the criteria of enforcement, then it shall be penalised with a fine. The owners or companies exempted for non-compliance under subparagraph (2) of section 31 of this Act shall be liable for a penalty.

Penalty for Faulty Branding :

If an individual or a business produces or engages in the storage, selling, distribution, or importation of misbranded food products, a penalty shall be levied with a fine. He or she will either have to destroy those food items or take immediate measures.

Penalty for Food Items Containing Unwanted or Foreign Matter :

When an individual or a corporation manufactures, sells, or imports food products for human consumption that are found to contain extraneous or alien matter, they are liable for a fine. 3. Hotels

Hotels with a star rating of up to 3 stars, or those that do not qualify for Central License, need to hold a valid State License.

4. Caterers

Catering businesses serving food at events, parties, or functions within the state must comply with FSSAI norms and obtain the license.

5. Retail Food Stores

Retailers who sell packaged or loose food items to end consumers, including grocery stores and supermarkets, require the license.

6. Vending Machines
